NUSHI Terms of Use

The Japanese version is the original. If the two differ, the Japanese
version governs.
NUSHI ("the app") is a service for sharing skateboarding spots on a map and for posting
and watching clips filmed at them. By using the app you agree to these terms.
1. Who can use it
- You must be 13 or older.

If you are a minor, get the consent of a parent or legal guardian before using the app.
- No account registration is required.
2. Your user ID

An anonymous user ID is issued when you start. We do not ask for your name or phone number.
An email address is collected only if you choose to enter one as a
reply address when contacting us.

The ID is held inside the app. If you delete and reinstall the app, or run "Erase my data",
you may no longer be able to carry over what you posted before.
3. What to post
- Clips showing skateboarding.
- Spot information for places where you can actually skate.
4. What is not allowed
The following is not permitted. If we find it, or it is reported to us, we may hide or delete
it and stop you posting, without prior notice.
- Sexual content, graphic violence, or content that insults, threatens or discriminates
against others.
- Anything that infringes someone else's rights (clips of a person filmed without their
consent, clips filmed by someone else, or content including third-party works such as
music).

Posting a clip showing a minor without the consent of their parent or legal guardian.
If you are filming their trick, or their figure is the subject, you must get consent first.
- Spot information for private property, places where entry is prohibited, or dangerous
places.
- Adding places you cannot actually skate, or places that do not exist.
- Anything unlawful, or content that encourages it.
- Information that identifies an individual (a home location, someone else's contact
details, and so on).
- Advertising, solicitation or spam.
- Impersonating another person or the operator.

Manipulating lordship, best trick or scores by any means, including using multiple user IDs
or trading likes with others.

Unauthorised access, probing for vulnerabilities, excessive automated use, or anything else
that interferes with running the app.

Use by members of organised crime groups or other antisocial forces, or by anyone connected
with them.
5. Reporting and blocking
- You can report from any clip, comment or chat message.
- If you block someone, their posts no longer appear on your screen.
- Reports are sent to the operator, checked, and acted on.
- Anyone who repeatedly posts inappropriate content may be stopped from posting, and their
past posts may be hidden.
6. Automated checks for safety
Clips, text and avatars that are posted go through automated checks for safety. Clips where
skateboarding cannot be confirmed are passed to a human for review.
These automated checks are not perfect, and do not monitor or guarantee
the content of every post. They can get it wrong. We may not be able to give an
individual reason for a post that was not published.
6-2. Requests from people who appear in a clip
At skateparks and similar places, bystanders can end up in the background. We do not prohibit
appearing in the background as such, but
if the person shown, or the parent or legal guardian of a minor shown,
asks us to remove a clip, we will unpublish it without asking why.
Requests are accepted through Contact.
We accept requests from people who do not use the app.
This does not release the person posting from their responsibility to obtain consent. If you
film someone in a way that identifies them, get their consent first.
7. How posts are handled
- Rights in the clips and other content you post stay with you.

You grant us a free licence to use your posts to the extent needed to provide, operate and
keep the app safe. Specifically this includes
copying and storing, public transmission (display and delivery),
generating thumbnails, converting to formats suitable for playback, analysis for automated
checks, and the minimum processing needed for display.

This licence is non-exclusive and has no territorial limit.
Because this processing is carried out by our processors (such as Google LLC, listed in the
Privacy Policy), it may be sub-licensed to them to the same
extent.

In addition to the above, you grant us permission to
use your posts to introduce, promote and advertise the app.
This includes the operator's official accounts (Instagram, TikTok, X and similar), the app's
website, its store listing, and advertising.

We will not use them to promote anything other than the app, and
we will not supply your posts to third-party advertising.

The licence lasts until the post is deleted. After deletion, use ends except for the period
technically needed for it to disappear from backups and records.
- You can delete your own posts from the app at any time.
- If a spot you added has clips from other people on it, the spot itself remains.
7-2. What is shown when we feature a post
As set out in section 7, posts may be used to introduce the app. What appears when we do is:

The clip, the spot name, the trick and the rider, plus
your account name if you gave one.
Your display name, avatar, score, comments and chat messages are never
shown.

The account name (Instagram, TikTok or X) is optional. If you
give one, it is shown when we feature the post and may be a link. If you do not, we feature
it without a name.

If you would rather we did not feature your posts, ask us through
Contact. Anything already posted does not disappear by itself, so
takedowns after the fact go through the same place (the same applies if you delete the post).

Whether to feature something is the operator's choice.
Not every post gets featured.
8. Suspension and deletion
If the operator judges that these terms have been broken, we may hide or delete posts, stop
you posting, or stop your use of the app, without prior notice. We may not be able to give an
individual reason for that decision.
9. Safety
Skateboarding carries a risk of injury. You skate at your own risk. The app does not guarantee
that you may skate at any place listed in it, and the operator is not responsible for accidents
or trouble at those places. Follow the instructions of the people who manage the site, local
rules and the law, and be considerate of pedestrians and everyone around you.
10. Changes to and suspension of the service
Features may be changed or stopped without prior notice. The app is run by one person, so a
response may take time.
11. Disclaimer
The app is provided as is, with no warranty of fitness for a particular purpose. The operator
is not responsible for exchanges between users, or for damage arising from what is posted.
This does not apply to damage caused by the operator's intent or gross negligence. Where the
Consumer Contract Act or other law does not permit all or part of a limitation of liability,
the operator is liable to the extent the law allows.
12. Changes to these terms
If these terms change, we will announce it by updating this page. Important changes will also
be announced in the app. If you use the app after such an announcement, you are taken to have
agreed to the changed terms.
13. Governing law and jurisdiction
These terms are governed by the law of Japan. For disputes concerning the app, the Tokyo
District Court is the exclusive court of first instance by agreement, to the extent this does
not conflict with the law.
14. Contact
Use the contact form on this site, or "Settings" → "Contact us" in
the app. Reports, deletion requests, disclosure requests and anything
else all go through this one place.
If you give a reply address we will contact you there where needed (depending on the content,
we may not be able to reply).
You can still use the form after deleting the app.
